About These Terms

These terms and conditions govern the relationship between byoliver, operated by Oliver Chestney of Dereham, Norfolk, and any client who engages byoliver for web design, development or hosting services. By engaging byoliver you agree to these terms.

Services

byoliver provides web design, development, hosting, maintenance and SEO services on a monthly retainer basis. The specific services provided will be agreed between byoliver and the client before work begins.

Payment

Services are charged on a monthly retainer basis with a minimum term of 3 months from the date the website goes live. Payment is collected automatically via Stripe on the agreed billing date each month.

After the initial 3 month minimum term, the agreement continues on a rolling monthly basis and can be cancelled by either party with 30 days written notice.

If a payment fails byoliver will notify the client and allow a reasonable period to update payment details. byoliver reserves the right to suspend services if payment remains outstanding after 14 days of notification.

Your Responsibilities

As a client you agree to:

Ownership and Intellectual Property

On commencement of the monthly retainer the website built by byoliver becomes the property of the client.

byoliver retains the right to display work completed for clients as part of its portfolio unless otherwise agreed in writing.

Third party software, themes and plugins remain subject to their own licensing terms.

Cancellation

Either party may cancel the service agreement with 30 days written notice sent to info@byoliver.co.uk.

On cancellation the client retains ownership of the website. byoliver will provide reasonable assistance to transfer the website to another host if requested, subject to agreement on any associated costs.

No refunds are issued for the current billing period on cancellation.

Hosting

Website hosting is included in the monthly retainer. byoliver will take reasonable steps to maintain uptime and security but cannot guarantee 100% uptime due to factors outside our control such as server maintenance or third party outages.

Limitation of Liability

byoliver will perform all services with reasonable skill and care. However byoliver is not liable for:

Our total liability in any circumstances shall not exceed the total fees paid in the three months prior to the event giving rise to the claim.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

byoliver reserves the right to update these terms with reasonable notice provided to clients by email.
